Δ8-THC, often referred to simply as delta-8, is an isomer of classical Δ9-THC. In natural cannabis it occurs only in very low concentrations – commercial products are practically always semi-synthetically produced from CBD.

Δ8-THC (delta-8) cannot be legally sold in the CZ

What is Δ8-THC?

Delta-8-THC differs from Δ9-THC only in the placement of a single double bond in the cyclohexene ring (at position 8 instead of position 9). This small change affects the molecule's pharmacological profile: Δ8-THC binds to the CB1 receptor somewhat more weakly than Δ9-THC, so the psychoactive effect is described as milder and less anxiety-inducing. In natural cannabis Δ8 occurs only in hundredths of a percent, arising mainly through oxidative degradation of Δ9-THC during storage. Commercially available Δ8-THC products were produced from hemp CBD by isomerization in the presence of strong acids – this laboratory route was the main reason for regulatory reaction in the USA.

The Δ8-THC boom occurred in the USA in 2020–2021, when this cannabinoid gained popularity as a 'legal' marijuana alternative. The wave subsequently spilled over into Europe, where it appeared in the form of vape pen cartridges, gummies, sublingual oils and concentrates. The main critical points were residual acids from isomerization, undeclared admixture of Δ9-THC and generally fluctuating quality of laboratory-produced batches.

Effects and mechanism

Users describe Δ8-THC effects as a milder and 'cleaner' version of classical cannabis euphoria. Typical is relaxation, light euphoria, mild distortion of time perception and reduced intensity of anxiety states compared to Δ9-THC. Onset after inhalation is rapid (5–15 minutes), orally 60–90 minutes, duration 3–4 hours after inhalation and 5–7 hours orally. Side effects correspond to the classical THC profile: dry mouth, red eyes, mild tachycardia, increased appetite. At higher doses paranoid states and impairment of cognitive function may appear. Clinical studies directly on Δ8-THC are very limited, most data come from analogy with Δ9-THC.

Legality of Δ8-THC in the Czech Republic 2026

In the Czech Republic Δ8-THC is classified under the same regulation as Δ9-THC and other psychoactive cannabinoids. Distribution, sale and possession for the purpose of distribution are punishable under the amendment to Act No. 167/1998 Coll. as worded in 2025. In Europe Δ8-THC is explicitly banned in France, Belgium, Austria, Germany and Italy. In the USA the situation differs from state to state, but the DEA has repeatedly stated that laboratory-isomerized Δ8-THC is not considered a legal cannabis derivative under the Farm Bill.
